UFCW Canada: Wal-Mart Windsor Vote Set for Tuesday,
March 8, 2005

WINDSOR, ONTARIO--(CCNMatthews - March 4, 2005) - The Ontario Labour
Relations Board (OLRB) has given the go ahead for a certification vote
at a Wal-Mart store on Tecumseh Road East in Windsor, Ontario.

The OLRB ruling followed an application filed by UFCW Canada (United
Food and Commercial Workers Canada) on Tuesday to represent a bargaining
unit at the store. Wal-Mart had objected to the bargaining unit as
proposed in the application, claiming managers and other contract
employees should also be included.

The board noted Wal-Mart's objection but ruled "the applicant's
bargaining unit description could be appropriate and the applicant has
established sufficient membership support in its proposed bargaining
unit for the purposes of obtaining a vote and having that vote counted."

In Ontario more than 40% of the proposed bargaining unit's employees
must show union membership support by card signing before the vote can
be ordered.

The OLRB ruled that all employees will vote but the ballots of those
outside of the proposed bargaining unit will be segregated as "there is
a dispute between the parties regarding certain positions and whether
they should be included in the bargaining unit. Any individual holding
such position is entitled to cast a ballot but that ballot shall be
segregated and not counted until the Board so orders or the parties
agreed."

The representation vote will be conducted on Tuesday by the OLRB at the
Tecumseh Road store commencing from 5:30 a.m. and finishing at 9:30 p.m.
at which time only the ballots of those employees in the proposed
bargaining unit will be counted.

The issue of whether to include the segregated ballots will be the
subject of OLRB hearings scheduled for March 30, April 4 and April 5.
