Verizon Wireless Call Center Employees Represented by Nichols Kaster, PLLP File Action to Recover Overtime Pay

ATLANTA, GA--(Marketwire - September 9, 2010) -  On September 8, 2010, Verizon Wireless call center employees Ira McCray and Demetrius Jones filed a case in the United States District Court for the Northern District of Georgia, on behalf of themselves and others similarly situated, to recover overtime pay. McCray and Jones worked as customer service representatives at Verizon Wireless' call center located in Alpharetta, Georgia. McCray and Jones allege in their Complaint that Verizon Wireless required customer service representatives to perform unpaid work before and/or after their shift. That work included, but was not limited to time spent booting-up computers, initializing software programs, setting up "call backs," and reviewing work related emails and internet messages. They claim that Verizon Wireless expected them to be ready to answer calls when their scheduled shift started, but did not pay them for the time they spent getting ready to take these calls.

Plaintiffs are represented by the law firm of Nichols Kaster, PLLP, which has offices in Minneapolis and San Francisco. One of its partners, Michele Fisher, stated "this is not the first time Verizon Wireless has been sued for failing to pay its employees for time spent performing work before and after their scheduled shifts. These employees performed this work for the benefit of the company, and should be paid for it."

The case is entitled McCray et al v. Cellco Partnership d/b/a Verizon Wireless, Civ. No. 1:10-cv-2821 (N.D. GA).
